[摘   要]《民法典》从民事基本法层面确认了消费者作为一个弱势群体的法律地位和民事权利,并将个人信息保护提升至一个新高度,为保险消费者等个人信息主体权益的实现提供了民事基本法依据。保险消费的专业性、复杂性与重要性决定了将保险消费者概念入法的必要性,中国宜将保险消费者限定为自然人,并限于自然人主要为生活消费目的购买保险产品或服务的行为。《民法典》时代保险消费者个人信息权益的实现仍存在诸多障碍,相关制度的完善可从三方面入手:一是应坚持保险消费者个人信息保护与利用平衡发展的理念;二是应进一步完善保险消费者个人信息保护与利用的具体规则;三是应强化保险消费者个人信息保护中的民事救济措施。

Civil Code and the Protection of Insurance Consumers′ Personal Information

Abstract:The Civil Code confirms the legal status and civil rights of consumers as a vulnerable group from the level of civil basic law,and promotes the protection of personal information to a new level.It provides the civil basic law basis for the realization of the rights and interests of insurance consumers and other personal information subjects.The professionalism,complexity and importance of insurance consumption determine the necessity of incorporating the concept of insurance consumers into the law.China should limit insurance consumers to natural persons and limit them to the behavior of natural persons purchasing insurance products or services mainly for the purpose of daily consumption.There are still many obstacles to the realization of insurance consumers′ personal information rights and interests in the era of Civil Code,and the improvement of relevant systems can start from three aspects:first,we should adhere to the concept of balanced development of insurance consumers′ personal information protection and utilization;second,we should further improve the specific rules for the protection and utilization of insurance consumers′ personal information;third,we should strengthen the civil relief measures in the protection of insurance consumers′ personal information.
